Terms of Service
The agreement between you, your club, and Poolside — written so you can actually read it.
By signing up, you agree to these terms on behalf of your club. If you don't agree, don't sign up. If you stop agreeing later, cancel — see "Cancellation" below.
1. What Poolside is
Poolside is a software service that helps neighborhood pool clubs run their operations: memberships, dues collection, applications, calendar, communications, board meeting minutes, gate access, and so on. We provide the tools; the club runs itself.
2. Your account
- You confirm you have authority to sign up your club. Typically this means you're a board member.
- You're responsible for keeping your sign-in credentials secure. Don't share passwords; use SMS/email magic-link sign-in when you can.
- You're responsible for what your admins do under their accounts. Add/remove admins promptly when board roles change.
3. Acceptable use
Don't:
- Use Poolside for anything illegal, fraudulent, or harmful.
- Send unsolicited bulk messages (spam) through our email or SMS systems. Members must have opted in.
- Attempt to break, reverse-engineer, or overload the service. Security research that follows responsible-disclosure norms is welcome — email us.
- Resell Poolside or repackage it as your own service.
- Upload content that infringes others' rights, including copyrighted material you don't own.
If you violate these, we may suspend or terminate your account. We try to give notice + a chance to fix the issue first; we may not in cases of clear abuse or legal urgency.
4. Subscription and payment
Poolside subscription (what you pay us)
- Free Forever for clubs up to 20 households. No card required, no time limit.
- Paid tiers (Starter / Pro / Enterprise) for larger clubs — see /pricing.html for current pricing.
- Subscriptions are billed annually in advance. Renewal is automatic unless you cancel.
- Pricing changes apply to your next renewal. We'll notify you by email at least 30 days before any change.
Member dues (what your members pay you)
- Card payments are processed via Stripe Connect. Stripe deposits funds directly to your club's bank — Poolside never touches the money.
- Poolside takes a small platform fee on top of Stripe's processing rate. Current rates are on the pricing page: 0.5% on dues, 1.5% on programs, 2.0% on parties, 0% on donations, 5% on late fees.
- Stripe's own fees (typically 2.9% + 30¢) are separate and charged by Stripe.
- Venmo, cash, check, and other off-platform payments incur no Poolside fee — you record them manually.
5. Cancellation and refunds
- You can cancel your Poolside subscription any time. The service runs until the end of your paid term.
- 30-day money-back: if you're not happy in the first 30 days of a paid subscription, email doug@poolsideapp.com and we'll refund the subscription. No exit interview.
- After 30 days, partial-period refunds aren't standard but we'll consider them case-by-case if something on our end materially failed.
- If we cancel your account for ToS violations, paid time isn't refunded.
6. Your data
- You own your club's data — household roster, applications, photos, documents, everything.
- You grant Poolside a license to display, process, and back up that data so the service works (run the public landing page, send emails, archive to your Drive, etc.).
- You can export your data at any time. See our Privacy Policy for details.
- If you delete your club, your data is hard-deleted within 30 days; backups roll off 30 days after that.
6b. SMS / text messaging program terms
Some Poolside flows use SMS to deliver transactional messages — one-time sign-in codes (OTP), unpaid-dues reminders, and account-status notifications (application approvals, party booking confirmations, etc.). These program terms apply when you use any feature that sends an SMS to a phone number you provided.
- Program description: Poolside SMS — transactional account notifications for pool club members and admin board volunteers. Sign-in codes, dues reminders, account status updates.
- Message frequency: recurring as needed for your account — typically 1–5 messages per active member per month. There is no fixed schedule; messages are triggered by your actions (sign-in requests, application submissions, dues lapses) or by board-initiated transactional notifications.
- Message and data rates may apply. Your wireless carrier may charge you for sending and receiving SMS messages; check your plan.
- Opt-in: by entering your phone number on a club's membership application form (e.g.
https://yourclub.poolsideapp.com/apply.html) or sign-in page (https://yourclub.poolsideapp.com/m/login.html) and submitting the form, you consent to receive transactional SMS messages from Poolside on behalf of your club. - Opt-out keywords: reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPTOUT) to any message to stop receiving SMS. You'll receive a confirmation message and no further texts.
- Help keywords: reply HELP (or INFO) for support contact information.
- Carrier disclaimer: wireless carriers (AT&T, T-Mobile, Verizon, US Cellular, Sprint, MetroPCS, Boost Mobile, Cricket Wireless, etc.) are not liable for delayed or undelivered messages.
- Privacy: your phone number is used solely to deliver the messages described above. Mobile information is not shared with third parties or affiliates for marketing or promotional purposes (see our Privacy Policy).

7. Service availability
We aim for high uptime but we're not promising specific SLAs at this stage. If the service is down for more than a day in a billing period, email us — we'll credit you fairly. Planned maintenance, third-party outages (Stripe, Supabase, Twilio, Google), and force-majeure events are excluded from any uptime expectation.
8. Disclaimers
Service provided "as is." Poolside makes no warranties — express or implied — about merchantability, fitness for a particular purpose, or non-infringement, beyond what's required by law.
The gate-access add-on involves physical hardware on your property and is provided after specific compatibility review. We're not liable for events at your physical pool, gate malfunctions caused by your network/power, or unauthorized entry caused by lost/shared credentials.
9. Limitation of liability
To the maximum extent allowed by law, Poolside's total liability to you for any claim is capped at the subscription fees you paid in the prior 12 months. We aren't liable for indirect, consequential, or incidental damages — lost profits, business interruption, lost data — even if we knew they were possible.
Some jurisdictions don't allow these limits; if yours doesn't, the limits apply only as far as the law allows.
10. Indemnification
You agree to defend, indemnify, and hold Poolside harmless from claims arising out of: (a) your club's content (applications, photos, documents you upload), (b) your violation of these terms, or (c) your violation of someone else's rights.
11. Changes to these terms
If we make material changes, we'll email each tenant's primary admin at least 30 days before they take effect. Continued use after that means you accept the new terms. If you disagree, cancel during the notice period.
12. Termination
- You can terminate at any time by canceling.
- We can terminate for ToS violations (with notice when reasonable) or if we shut down the service entirely (we'll give 90 days' notice + a data export).
- On termination, your data is deleted per the Privacy Policy.
13. Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts of San Francisco County, California, except where applicable law allows you to insist otherwise.
